The European Union (EU) Digital Services Act (DSA) is a new law designed to protect online consumers by regulating obligations of third-party marketplaces, such as Bandcamp. If you are interested in reading more, you can head to the European Commision site here. For how this affects accounts on Bandcamp specifically, read on below.
As part of this legislation, Bandcamp is required to collect, verify, and display information on some Artist and Label accounts who are registered as a trader, or professional seller.
How do I know if I’m a trader?
You might be considered a trader if any of the following applies:
- A significant part of your income comes from Bandcamp or other online marketplaces
- You are registered for VAT
- You employ other people or services to help with your Bandcamp sales or fulfillment
- You have your own website selling the same items that are on your Bandcamp page
If none of the above apply to you, you still might be considered a trader under EU law and/or relevant member states in the EU. We are unable to give legal advice, so if you don’t know whether you are considered a trader, we recommend reaching out to a legal advisor.
If you think you are a professional seller or a trader, head to the Legal Compliance section in your Profile page.
What am I required to do as a trader?
As a trader, you must:
- Verify your identity. If you have not already verified your identity with us, you will need to submit your seller information and ID documents through Trolley, our third-party verification service.
- Offer at least a 14-day return policy. You must have a 14-day (or more) return policy for eligible items shipped to the EU and UK.
- Comply with all other EU and UK consumer protection laws.
What information will be displayed?
Once you register as a trader, we are required to display the following information on the Buy Now dialog of your items:
- Your business or artist/label name
- Your business address (this may be a residential address if you operate your business from your home)
- Your business phone number
- Your business email address
- Your business registration number, if applicable
What if my information has changed since I last provided it?
You are required to keep your information up to date. If anything changes, please re-submit the updated information via the links under the Legal Compliance section of your profile page.
Return Policy for registered traders
Registered traders on Bandcamp are required to offer a 14-day return policy on all physical merch items shipped to EU or UK-based buyers. When registering as a trader, Bandcamp will add a shipping and returns policy section to your page or update your existing one.
How you process returns is up to you and you are not obliged to cover the cost of returns or exchanges.
This right to return does not extend to custom-made physical products and perishable goods, unless otherwise specified by the seller. Digital content may not be eligible for return after download. Rules governing digital content vary by EU member state.
